01 / THE PERSON BEHIND THE CASE

The crash ended.
His fight did not.

On September 27, 2020, I was a passenger in a Toyota Highlander involved in a collision in Sacramento, California. I was experiencing homelessness at the time.

What followed was another struggle: seeking continuing treatment, gathering records, finding legal representation, and paying the expenses of pursuing a claim.

Lisa Garcia, the driver, settled her claim with Toyota while mine remains unresolved. My position is that the seats and restraint system failed to protect me adequately during the collision. Toyota disputes my claims.

I have contacted more than 500 attorneys and spent approximately $20,000 pursuing this matter. These are my reported figures, not independently audited totals. I am representing myself while continuing to seek legal assistance.

The medical records reviewed for the magazine feature describe emergency treatment, continuing symptoms, and later evaluations.

Emergency treatment

September 27, 2020 UC Davis records document an eyelid laceration repaired with four sutures. The emergency history records head injury and loss of consciousness; the discharge summary reports no acute injury on imaging.

Symptoms that continued

October 2–3, 2020 records describe headaches, brain fog, and neck and arm soreness. The clinical impression was postconcussive syndrome and musculoskeletal neck pain.

Later evaluations

An August 2021 specialist consultation records continuing neck and lower-back pain, arm and hand symptoms, and right-side joint pain. Its MRI review describes cervical disc protrusions.

The earlier injury matters, too.

An April 2021 neurologist’s report describes a pre-existing traumatic brain injury and cognitive difficulties aggravated after a second collision. The records include a 2018 collision. They do not establish that every condition began in September 2020 or determine Toyota’s liability.

Look beyond the headline.

My position is that the seats deformed during a sequence of impacts and that my restraint did not adequately protect me. I maintain that I was wearing my seat belt.

The supplied Toyota defendants’ answers deny his claims and assert defenses. Photographs alone cannot establish a defect, causation, or liability. Those questions require the full record and competing evidence.
